Terms of Use
These terms are the agreement between you and Meline LLC (“we”, “us”) for GoodBully on iPhone and Android, including GoodBully Pro. By installing or using GoodBully you agree to them. If you don’t agree, don’t use the app.
1. Your licence to use GoodBully
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use GoodBully on devices you own or control, for your own non-commercial use. On iPhone this licence is also subject to the Usage Rules in Apple’s Media Services Terms and Conditions; on Android, to the Google Play Terms of Service. GoodBully is licensed to you, not sold. We and our licensors keep all rights not expressly granted here, including all intellectual property in the app, its words, its artwork and the mascot.
2. What you may not do
- Copy, modify, or create derivative works of GoodBully, except as the law allows despite this restriction.
- Reverse engineer, decompile or disassemble it, or try to extract its source code, except as the law allows despite this restriction.
- Rent, lease, lend, sell, sublicense or redistribute it, or make it available over a network where others could use it at the same time.
- Remove or alter any notices of ownership, or use it to break the law or anyone else’s rights.
- Get around its purchase checks to use GoodBully Pro without paying for it.
3. What GoodBully is, and isn’t
GoodBully is a self-management tool. It counts time you spend in apps you choose and puts a screen in front of them when you’ve set it to. It is not a medical device, not treatment for any condition, and not a parental-controls product; don’t use it to control someone else’s device.
Research and health figures. GoodBully quotes findings from published research, for example how much longer people who exercised a certain amount lived than people who didn’t, or what time spent on a phone adds up to over a lifetime. These describe what studies found across groups of people. They are general information, not medical advice, and not a prediction or guarantee of any result for you. Exercise counts and goals come from Apple Health or Health Connect and are only as accurate as the data your devices record. If you have a health condition, talk to a doctor before changing how much you exercise.
You choose what it limits and how strictly. Strict mode, strict schedules and focus sessions are designed so that you can’t get past them until they end, and turning them off early is intentionally hard. Only turn them on for apps you can do without for that time. GoodBully does not block your phone’s emergency calling, but don’t rely on any app you’ve limited for anything urgent.
The shield’s messages are meant to be blunt, and at the intensity you choose they can be harsh. You can turn the intensity down at any time.
Limits are enforced by your phone’s own systems (Screen Time on iPhone; usage access and a screen overlay on Android). They can be affected by your settings, by the operating system, or by the phone’s maker, and we can’t promise a shield will always appear.
4. GoodBully Pro
Some features are part of GoodBully Pro, a subscription sold through the App Store on iPhone and Google Play on Android. The store that takes your payment also handles billing, renewals, cancellations and refunds under its own terms. Subscriptions renew automatically until cancelled; a free trial, where offered, becomes a paid subscription unless you cancel before it ends. Prices are shown in the store before you buy. How to cancel and how to ask for a refund are on our Refunds and cancellation page. We may change what Pro includes or what it costs; a price change never applies to a period you’ve already paid for.
5. Other services
GoodBully works with services that belong to others, such as the App Store, Google Play, Apple’s Screen Time and Health, Google’s Health Connect, and our analytics provider. Your use of them is under their terms, and we’re not responsible for them. You must follow any third-party terms that apply when you use GoodBully, such as your wireless carrier’s.
6. Your information
How we handle what the app reads and what you give it is set out in our Privacy policy, which is part of these terms.
7. No warranty
GoodBully is provided “as is” and “as available”, with all faults and without warranty of any kind. To the fullest extent the law allows, Meline LLC disclaims all warranties and conditions, express, implied or statutory, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment and non-infringement. We don’t promise that GoodBully will meet your needs, will be uninterrupted or error-free, that its counts will be exact, or that defects will be corrected. No advice or information from us creates a warranty. Some places don’t allow some of these exclusions, so some may not apply to you.
8. Limits on our liability
To the fullest extent the law allows, Meline LLC will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill or opportunities, or for anything that follows from an app being shielded or not shielded, arising out of or related to your use of or inability to use GoodBully, however caused and on any theory of liability, even if we were told such damages were possible. Our total liability to you for all claims is limited to the greater of the amount you paid for GoodBully Pro in the twelve months before the claim and fifty US dollars (US$50). These limits apply even if a remedy fails of its essential purpose. Some places don’t allow these limits, so some may not apply to you.
9. Ending these terms
These terms last until ended by you or us. You can end them by deleting GoodBully from your devices. Your rights under them end automatically if you don’t follow them. When they end you must stop using the app. Sections 7, 8, 11 and 12 survive.
10. If you use GoodBully from an iPhone
These terms are between you and Meline LLC only, not Apple. Meline LLC, not Apple, is solely responsible for GoodBully and its content. Apple has no obligation to provide maintenance or support for it. If GoodBully fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the app, if any; to the maximum extent the law allows, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses from any failure to conform to a warranty are Meline LLC’s responsibility. Meline LLC, not Apple, is responsible for addressing any claims by you or a third party about GoodBully or your use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws. If a third party claims GoodBully or your use of it infringes their intellectual property, Meline LLC, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim. Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
11. Export and U.S. Government use
You may not use or export GoodBully except as U.S. law and the laws of where you got it allow. If you are a U.S. Government end user, GoodBully is “Commercial Computer Software” and “Commercial Computer Software Documentation” licensed only as a commercial item with the rights given here.
12. General
These terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-laws rules, and not by the United Nations Convention on the International Sale of Goods (CISG). If you live in the European Union, the United Kingdom or another place whose law gives you the right to bring claims in your own courts or under your own law, nothing here takes that away. If any part of these terms is unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver of it. You may not transfer these terms; we may transfer them with the app. These terms and the Privacy policy are the whole agreement between you and us about GoodBully, alongside the terms of the store you got it from (on iPhone, Apple’s Licensed Application End User License Agreement; on Android, the Google Play Terms of Service).
13. Changes
We may update these terms. The current version is always on this page with its effective date. If a change is significant we will say so in the app before it takes effect. Using GoodBully after a change takes effect means you accept it.
